Here comes the usual legal stuff — but it has to be said!


I. CONCLUSION OF THE TRAVEL CONTRACT

By registering for a trip—whether in writing, verbally, or by phone—the customer makes a binding offer to HAGEN ALPIN TOURS, located in Mittelberg, to enter into a travel contract. When registering multiple participants, the person registering is liable for their contractual obligations as well as their own, provided they have explicitly agreed to this. The contract is formed upon acceptance by HAGEN ALPIN TOURS. The customer will receive written confirmation immediately or shortly after the contract is finalized. The customer agrees to the storage of their personal data.


II. PAYMENT

Upon conclusion of the contract, a deposit of at least 20% of the total price per participant is due. The balance must be paid no later than 28 days before departure. For trips requiring a minimum number of participants, final payment is due only after HAGEN ALPIN TOURS confirms the trip will proceed. HAGEN ALPIN TOURS is insured through R&V and provides a financial protection certificate. If full payment is not received by the departure date—even though the customer has received a protection certificate—HAGEN ALPIN TOURS may cancel the booking and charge cancellation fees, unless the customer had legal grounds to withhold payment.


III. TRAVEL DOCUMENTS

If travel documents are not received at least seven days before departure, the customer must contact HAGEN ALPIN TOURS immediately.


IV. SERVICES

The scope of services is based on the offer and the booking confirmation referencing that offer.


V. CHANGES TO SERVICES AND PRICES

If the customer makes changes (e.g., travel date, destination, departure airport), a fee of €50 per change applies. Minor changes to services are permitted if they do not significantly alter the nature of the trip. HAGEN ALPIN TOURS may increase the trip price after booking if transportation costs, taxes, or exchange rates change, provided the increase is clearly explained. This is only allowed if more than four months pass between booking and departure. If a price increase of more than 5% occurs, or if there are significant changes, the customer may cancel free of charge or choose a replacement trip of equal value.


VI. CUSTOMER CANCELLATION

The customer may cancel at any time before departure. Cancellation must be sent to HAGEN ALPIN TOURS and is effective upon receipt. Written cancellation is recommended. Fees apply as follows:

  • Up to 31 days before departure: 20%

  • 30 to 1 day before departure: 90%

  • On the day of departure / no-show: 100%

  • Lift tickets: always 100% cancellation fee

Heli- and cat-skiing trips are booked via third-party operators, and their conditions apply. Customers may provide proof of lower actual costs in the event of cancellation.


VII. CANCELLATION DUE TO FORCE MAJEURE

If the trip is significantly disrupted by force majeure (e.g., war, natural disasters, epidemics), either party may cancel. The customer receives a refund for payments made, minus services already rendered. Extra return travel costs are shared equally.


VIII. SPECIAL COSTS

Costs arising due to changes caused by the customer (e.g., missed flights, early return due to illness or accident) must be paid by the customer. If HAGEN ALPIN TOURS advances costs in an emergency, these must be reimbursed after the trip. Health and travel insurance are not included but are strongly recommended.


IX. CANCELLATION BY THE OPERATOR

HAGEN ALPIN TOURS may cancel:

  • Up to 14 days before departure if minimum group size is not reached (this must be stated in the offer). Full refund applies.

  • If the customer severely disrupts the trip or fails to meet physical/participation requirements. In such cases, HAGEN ALPIN TOURS retains the right to payment but must deduct saved costs or income from reselling services.


X. WARRANTY / LIABILITY / CUSTOMER OBLIGATIONS

If a service is not delivered as promised, the customer must notify the tour guide immediately. HAGEN ALPIN TOURS may offer a reasonable substitute. Claims are void if the customer does not report issues promptly. Contract cancellation due to defects is only permitted after HAGEN ALPIN TOURS has had a chance to remedy the issue, unless remedy is impossible or unreasonably delayed.


XI. CLAIMS AND LIMITATION PERIOD

Claims for price reduction, damages, or reimbursement must be made within one month after the trip ends. Claims must be made directly to HAGEN ALPIN TOURS—not to guides or local reps. Contractual claims expire after one year; tort claims after three years.


XII. LIMITATION OF LIABILITY

HAGEN ALPIN TOURS only acts as an agent for flights; airline terms apply.

  • Contractual liability for non-physical damages is limited to three times the trip price, unless caused by gross negligence.

  • Tort liability is limited to €4,100 per person.
    HAGEN ALPIN TOURS recommends travel insurance, including accident and luggage coverage.


XIII. ENTRY & HEALTH REGULATIONS

Customers are responsible for complying with passport, visa, and health regulations. HAGEN ALPIN TOURS is not liable for delays in visa processing unless caused by their fault.


XIV. SEVERABILITY

If any part of the contract is invalid, the rest remains valid.


XV. JURISDICTION

Jurisdiction is the registered office of HAGEN ALPIN TOURS for all business clients, and for customers without a domestic legal venue.
